Terms of Use

1. Acceptance of terms

Your use of the Applications constitutes a binding agreement between you (“User”) and Ozan Yukruk (“Developer”, “we”, “us” or “our”). If you use the Applications on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

2. License grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Applications for personal, non-commercial use, in accordance with these Terms and Apple’s App Store terms. No ownership rights are transferred to you.

3. Media player only

Smart IPTV Pro Player is a media player. It does not provide, sell or include any channels, movies, series, playlists or IPTV service. You are solely responsible for the playlists, Xtream Codes logins and other sources you add, and for making sure you are authorized to access that content. We do not control, host or endorse content from third-party providers.

4. Restrictions

You agree not to:

• Reverse engineer, decompile or disassemble the Applications
• Modify, adapt or create derivative works of the Applications
• Use the Applications for unlawful, harmful, abusive or fraudulent purposes, including accessing content you are not authorized to view
• Circumvent security mechanisms or access restrictions
• Exploit bugs or vulnerabilities, or abuse rate limits
• Use automated systems to access or scrape the Applications
• Infringe intellectual property or other proprietary rights
• Use the Applications in a way that could harm the Developer or other users

Violation may result in immediate termination without notice.

5. User responsibility

• You are solely responsible for how you use the Applications.
• You are solely responsible for any content you add, process or generate using the Applications.
• You are responsible for ensuring your use complies with applicable laws and third-party rights.
• You are responsible for backing up your own data and maintaining your device security.

6. Intellectual property

All rights, title and interest in the Applications, including software code, design, logos, trademarks, text and databases, remain the exclusive property of Ozan Yukruk. Unauthorized use is prohibited.

7. User content

If an Application lets you submit, store or generate content (“User Content”), such as playlist profiles:

• You retain ownership of your User Content.
• You grant the Developer a worldwide, royalty-free license to host, store, process and transmit your User Content solely to operate, maintain and provide the Applications, for example to sync playlist profiles between your devices.
• You confirm that you have all rights necessary to provide the User Content.
• We may remove User Content at our discretion.

8. Payments and subscriptions

In-app purchases and subscriptions are processed by Apple. We do not store your payment information. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel them in your Apple ID settings. Billing disputes and refunds are handled under Apple’s policies. A subscription to the Applications does not include any IPTV provider subscription. We may change pricing, offerings or subscription tiers to the extent permitted by Apple and applicable law.

9. Updates and availability

We may modify the Applications at any time, add or remove features, suspend or discontinue functionality, or change supported devices and OS versions. We do not guarantee that any feature will remain available.

10. Termination

We may suspend or terminate your access to any Application, with or without notice, for violations of these Terms, suspected abuse or legal compliance.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Applications are provided “as is” and “as available” without warranties of any kind. We disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability and availability. We do not guarantee that any stream or source will play.

12. Limitation of liability

To the maximum extent permitted by law, Ozan Yukruk is not liable for any direct, indirect, incidental, consequential, special, punitive or exemplary damages, including loss of profits, loss of data, business interruption, device damage or personal injury, arising from or related to the Applications or these Terms.

If liability cannot be fully excluded under applicable law, total liability is limited to the amount you paid for the relevant Application in the preceding twelve months, or zero if the Application was free. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify, defend and hold harmless Ozan Yukruk from any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from your use of the Applications, your violation of these Terms, your violation of any law or your infringement of third-party rights, including rights in content accessed through playlists you add.

14. Third-party services

The Applications may integrate third-party services or play third-party content. We are not responsible for third-party services, outages, content or data practices. Their use may be subject to separate terms.

15. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including Internet outages, platform changes by Apple, government actions, natural disasters, cyberattacks or hosting failures.

16. No class actions (where permitted)

To the extent permitted by law, you agree to resolve disputes individually and waive the right to participate in class actions, class arbitrations or representative proceedings.

17. Governing law

These Terms are governed by applicable law, without regard to conflict-of-law principles. Disputes will be brought before the competent courts as determined by applicable law.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

19. Entire agreement

These Terms, together with the Privacy Policy and Apple’s Licensed Application End User License Agreement, form the entire agreement between you and Ozan Yukruk regarding the Applications.
